How Is Severance Calculated in Ontario?
In short: Ontario's Employment Standards Act gives most terminated employees termination pay of 1 week per completed year of service (max 8 weeks), and adds statutory severance of 1 week per year (max 26 weeks) for employees with 5+ years at employers with a $2.5M+ Ontario payroll. Common-law reasonable notice — what courts actually award absent a valid contract clause — often runs far higher.
| Entitlement | Formula | Cap | Who qualifies |
|---|---|---|---|
| Termination pay | 1 week × completed years (min 1 week) | 8 weeks | 3+ months of service |
| Statutory severance | 1 week × years + prorated months | 26 weeks | 5+ years AND $2.5M+ Ontario payroll |
